Legal Action

Several DC communities and Georgetown University have filed a lawsuit with the DC Federal Circuit Court of Appeals challenging the new flight path.  The DC Coalition also filed a formal Petition to the FAA seeking immediate relief from the aircraft noise caused by the new route.  Although the DC Coalition’s interests do not cover noise over Montgomery County, our interests are aligned in so far as the DC effort seeks to require the FAA to do a full Environmental Assessment under federal law of the new flight path in order to consider the impacts of the increased traffic and to return to the former flight paths until such assessment is completed.  To learn more about the DC effort click here.

On February 9, 2017, Howard County Council authorized the Howard County Office of Law to institute legal proceedings against the FAA related to the implementation of NextGen air traffic noise from BWI.  For a copy of the Howard County legislation, please see the "Howard County Bill No. 8-2017.pdf" document under the Downloads and Templates tab.


As of January 10, 2017, Montgomery County has taken no steps toward legal action against the FAA.
